CULTURE COMPETENCE ADVOCACY AND MEDIATION PROGRAM (cCAMP)
RESOURCE – AFFILIATION AGREEMENT

This agreement sets for the terms and understanding between WEN and the undersigned affiliate desiring to be listed in WEN’s network of resources to be made available to citizens, including marginalized or underprivileged groups.

PURPOSES
The goal of this Memorandum of Understanding (MOU) is to establish a partnership with you and/or your firm as one of the participating resources in our network of resources available to offer your paid or non-paid professional services to members of the communities, through a formalized process.

You agree that WEN will assume the program/project management role, which includes planning, scheduling, communications, risk, quality management to ensure an agile and effective collaborative process. As such, WEN requires strict adherence to its requirements, which includes your timely written responses and updates, transparency, and accountability. WEN cCAMP Director will be the contact person but, in his absence, please contact the CEO. To ensure the integrity of WEN’s activities, information and disclosures are treated as a matter of principle and legal requirements on the STRICTEST CONFIDENTIALITY. Thus, you are required to sign the below confidentiality, non-disclosure, to allow the free flow of information amongst affiliate/partners involved in this case. Please review this confidentiality agreement of understanding and affirm you agree with it.

World Ebony Network (WEN), an ethnic equity and equality, 501c3 charitable and educational organization, with a culture competent based portfolio that works with diverse groups, to plead and advance their social economic causes utilizing WEN CULTURE COMPETENCE ADVOCACY & MEDIATION PROGRAM (cCAMP). cCAMP is decomposed into the following seven or more deliverable components (aka work packages) to address various client needs: Economic, legal referral services, cultural advocacy, prevention and diversion, literacy, research and inquiry, and welfare services. It is on record that WEN has appeared and intervened in cases before judges at the following courts:

cCAMP – PREVENTION AND DIVERSION DESCRIPTION


cCAMP – Prevention and Diversion work package provides an accountable and reconciliatory program/platform for inmates to understand their actions and how these actions impact their victims, families, and communities with the goal of promoting healing and learning toward behavior modification and ultimately being a good citizen. WEN’s cCAMP has been used in federal and state courts by lawyers and judges where they have considered it a culture appropriate solution.


The cCAMP comprises the below steps:


Step 1: The Individual Development Plan (IDP), which assesses all aspects of an offender’s life and matches him or her with mentors who will provide guidance to accomplishing this plan.

Step 1a: The IDP areas include SPIRITUALITY – their ability to organize their minds and thoughts, beliefs (E.g., Discipline, Patient, Listening, etc.)), SUPPORT/SKILLS (Social, Cognitive, Emotional, Physical), ECONOMICS SUSTAINABILITY (Jobs, Credit Score), EDUCATION (College, Certifications, Trade training and skills).

Step 1b: Mentorship will provide and assign men and women in the community to the inmates in the various IDP Need Areas, who are willing to invest their time in producing a contributing member of the society. Mentors ensure inmate’s participation in the various aspects of the program and evaluate inmate’s performance in the identified IDP need areas.

Step 1c: Services by Affiliates will provide specialized professional services by referral, if necessary, to work with the inmate for his or her well-being to further address and deal with the issue(s) confronting him or her. Service areas range from legal to clinical treatments. Because of the role of spiritual care in social change, including at-risk communities, professional services, such as chaplaincy, are presented to inmates and their families if desired.

Note: WEN does not get involved in any financial discussions nor does it influence the decision of the provider. Under WEN’s cCAMP-Welfare, WEN will assist in obtaining the necessary documents (i.e., birth certificates, identification, etc.) to facilitate this service.

Step 2:The Supportive Intermediary Restorative Practice (SIRP) will enable him to explore where he is defaulting with his mentors, family members, and others so that he can have a better perspective of his situation.

Step 3: The Cultural Heritage Education (CHE) will allow him to participate in culture-based classes that will reinforce the philosophies, principles, and practices of his ethnic extraction while appreciating the good aspects of other heritages.

Step 4: Communication/Evaluation Management: WEN provides and reports activities and evaluations to the client’s attorney, which is in turn provided to the seating judge for consideration in sentencing.

Communication Management: Following the structured schedule established by WEN, mentors and professional providers are required to provide a written update of their activities with the client/inmates. We do understand that you have a professional/client confidentiality agreement in place, so your status report should not involve what you share in confidence with your client. However, if the client permits WEN in writing to be previewed to his or her case, please expect us to be involved in the discussion of client’s case. Your status update should include your scheduled sessions, any challenges, changes in schedule, etc. The communication process varies from case to case and might require weekly, bi-weekly, or monthly updates. Please check with the WEN cCAMP team for the assigned case.

Evaluation Management: Following the structured schedule established by WEN, mentors and professional providers evaluate and provide written inmate’s performance in the designated IDP need areas (in the case of mentorship) and adherence/performance to services provided (in the case of professional service).

Because meeting and managing stakeholder’ expectations, require compliance of the state declaration of rights as well as other laws, WEN will appreciate proper activity coordination with respect to these case management to get the maximum results. Our experience shows that some attorneys are non-corporative and shut down when they perceive too many voices communicating with them on a case while others do not and lack of structure.

To close or minimize the constraints that are likely to impact the successful outcome of cases, we request you agree that WEN takes the lead role (see below) of coordinating stakeholder meetings and keeping all informed in a timely manner, which includes the above requirements. Hence, your timely response is highly appreciated.

As such, you are required to sign the attached confidentiality, non-disclosure documents, to allow for free flow of information amongst partners involved in this case.

Explanation of Lead Role

While WEN takes the lead role, it is not insinuating that other stakeholders are less inferior or are subordinates to WEN. WEN leadership role is simply a management one to coordinate and manage the communication flow among stakeholders required to bring out a more effective result in any case. While lead role activities are executed on a case-by-case basis, please provide the following:

  • Once you have signed our affiliation partnership agreement, you will be previewed to the information on:
    • Attorney on the case – Whether the subject or the responsible relative of the Adult subject of the case referred to you has retained legal counsel or one is assigned by the court.
    • Detention, jail, prison, where the victim is held
    • Other stakeholders – family, friends, etc., involved in this case.
  • Where possible, we will convene individual or group meetings, preferably at our office. Bear in mind that since WEN is offering this service to the client at no charge, we prefer to utilize the least expensive resource, which is our office. We do know that we incur the expenses of our jail visitations, court appearances, lawyer visits expenses, etc.
  • Character reference letters – With provided contact information of family and friends, WEN reaches out and requests character reference letters that the judge gives weight to in his/her sentencing.
  • Scheduling visitations to conduct enlightenment sessions with inmates.

Please review this confidentiality agreement and statement of understanding and affirm you agree with it.


Partnership Confidentiality Agreement

I agree that all information shared with me is strictly confidential. With respect to this matter, I acknowledge that from time to time, I may need to disclose elements of the communications to WEN as part of my participation, progress, progress/status reporting, and tracking process.


I understand there are a few situations where WEN is required by law to report to authorities:

  • If any information is disclosed about child abuse or neglect
  • Substance, behavioral, or any kind of abuse to self
  • If any information is disclosed about the abuse, neglect, or financial exploitation of a senior citizen who is unable to seek assistance for himself or herself
  • If suicide is threatened
  • If bodily harm or death to another person is threatened
  • When a crime has been committed
  • Undisclosed Communicable disease

I understand that any breach of this confidential communication will result in immediate termination of this relationship without further notice.

RETAINERSHIP/FEES

It will be prudent of all parties to appreciate the effort involved in running this program. This MOU is not a commitment of funds. Funding may be required based on the nature, scope, and size of the audience. It may be possible to charge administrative fees for services or workshops in the future. This is subject to change based on the effectiveness and workload of this program.

DURATION

This MOU may be modified by mutual consent of authorized officials from WEN and the undersigned. This MOU shall become effective upon signature by the authorized officials from WEN and the undersigned and will remain in effect until modified or terminated by any one of the partners by mutual consent.
